If you're interested in pursuing a career in law or criminal investigation, this course will introduce you to the basics of criminal law. Covering the history of criminal trials, the class explains the methods and procedures involved in the Criminal Justice System in Ireland.

 

FETAC Criminal Law Certificate Level 5

The Criminal Law Certificate will provide learners with a thorough understanding of the principles of criminal law and enable them to appreciate the role of criminal law in their personal and vocational lives. It is also intended to prepare learners for employment or further study in related areas.
 
The course will be delivered by a panel of professional & academic lecturers.  Most have postgraduate qualifications, many are published in their areas of expertise and all are employed in legal and/or criminal settings.

Pre-requisites

Access to the Certificate in Criminal Law is open to all however it is preferred that applicants hold a Level 4 Certificate, Leaving Certificate or equivalent qualification and/or relevant life and work experience.  Applicants are advised to apply as early as possible as demand for places is likely to be high.  Applications must be received and approved prior to course registration.

Course Aim

The programme will study the principles of Criminal Justice providing learners with an understanding of the Criminal Trial Process.  Case studies will be used for demonstration purposes and learners will:

  • Develop a general understanding of the Irish Criminal System.
  • Develop an appreciation of the elements required for a crime to be committed.
  • Evaluate the impact of relevant legislation governing the various aspects of criminal law to be investigated.
  • Acquire skills in evaluation and analysis.
  • Be familiar with the language and procedures related to the various aspects of criminal law studied.

Principal Areas of Study

The Certificate in Criminal Law is composed of five units:

Unit 1: Introduction to the Irish Criminal Law System

  • Investigate how the relevant articles under the constitution protect Irish citizens in society against crime.
  • Provide examples of different types of crime.
  • Explain the nature of: an actus reus and mens rea of a crime.
  • Explain the terms - accomplice to crime, principal in crime, accessory after the fact.

Unit 2: The Criminal Court System and Arrest and Detention

  • Summarise the functions of the Gardai, Courts, Prison Service, Probation Service and Director of Public Prosecutions in the Criminal Justice System.
  • Demonstrate an understanding of the Criminal Court System outlining in detail the five main courts.
  • Define arrest and outline the powers provided to Gardaí at Common Law.

Unit 3: The Crime of Homicide

  • Define homicide and state two types of homicide - murder and manslaughter.
  • Explain provocation and refer to relevant case law.
  • Briefly explain euthanasia, abortion and infanticide.

Unit 4: Theft, Burglary, Aggravated Burglary and Robbery

  • Refer to the actus reus and rnens rea of theft.
  • Provide examples of ordinary thefts and specific thefts such as electricity and gas.
  • Define aggravated burglary,.
  • Define robbery.
  • Refer to relevant case law in robbery, theft and burglary.

Assessment

The course will be delivered using a variety of methods including lectures and seminars.  Students will have the opportunity in seminars to participate in group discussions.  Students will be assessed by way of assignments (2) and a theory based examination.  The assignments may be presented in variety of media e.g. written, audio, graphic, visual or any combination of these.  The examination will be based on a range of specific learning outcomes and will be 2 hours in duration.  It will comprise 6 short questions and 4 structured questions.

Awards

Upon successful completion of the programme, graduates will receive a Level 5 FETAC Component Certificate in Criminal Law.  FETAC (the Further Education and Training Awards Council) is the national awarding body for further education and training in Ireland.
